Terms of Service

1. Scope & provider

These terms govern use of streamwizard.de, the dashboard, downloads, API, and the OBSBot (24/7 stream) and giveaway system (giveaways, community prizes, streamstats) applications. The provider is the operator named in the imprint. By using the service you accept these terms. For paid services (Premium, VIP, Diamond), our terms and conditions additionally apply.

2. Account, login & responsibility

Login is performed via Discord (OAuth). You are responsible for the security of your Discord account and for the content and data you process as a creator via StreamWizard. Features may only be used with accounts, channels, servers, and content you are authorized to manage.

3. Services & scope

• OBSBot: 24/7 playlist operation, OBS control, Twitch/Kick chat, optional backup control (skip/recover/update).
• Giveaway system: tickets, draws, claim workflow; community prizes via Discord forum; streamstats with watchtime, chat counters, bits, gift subs, and top-supporter ranking. Streamstats stores only counters, no chat content.
• Bot Protection: the creator can maintain a block list of Twitch login names; for listed names, no new points, watchtime, or bonuses are credited in the giveaway (accrual is frozen); the existing balance is preserved unchanged – nothing is set to 0 or deleted. Viewers with a genuine monetary contribution (active sub, bits, gifted subs) are exempt and keep earning normally. Giveaway points and tickets are free participation values with no monetary value and no claim to payout.
• Central Discord runtime (StreamwizardNode) holds the single gateway connection of the system bot. OAuth/token bridge for Twitch, Kick, and Google/YouTube runs on our server; system client secrets stay there.
• Live translation (CaptionBridge): local speech recognition sends captions to StreamWizard; translation uses the creator's own API key (Anthropic, OpenAI, DeepL, Google) and is shown to viewers via the Twitch extension. Available only after admin entitlement; on revocation the service is refused immediately.
• Feature scope, availability, and limits may change (platform APIs, maintenance, beta features). There is no entitlement to a specific feature state or support.

Where features process viewer data or enable prizes/giveaways (e.g. watchtime, tickets, creator prizes, community prizes), you as creator are the organizer and responsible for clearly informing viewers about rules, participation, prize fulfillment, contact options, and data handling. StreamWizard only provides the technical platform for this and is neither organizer nor sponsor of your creator giveaways. See the privacy policy for purposes and legal bases.

For live translation you use your own API key of the chosen AI/translation provider and are responsible for complying with its terms as well as for the lawfulness of the content captured via CaptionBridge and transmitted to the provider. Translations are machine-generated – without warranty of accuracy or completeness. CaptionBridge may only be used with your own stream audio.

4. Single-instance rule

Only one active bot runtime per account is permitted (session lock, heartbeat monitoring). Parallel multi-use or circumvention via multiple devices is not allowed and may lead to blocking.

5. API key & downloads

• API keys and signed download links are credentials – treat them like passwords and do not share them.
• Automated retrieval, scraping, or bypassing limits is prohibited.
• On suspicion of abuse we block or rotate keys.

6. Third-party platforms

The terms, developer rules, and trademark guidelines of Discord, Twitch, Kick, Google, and YouTube additionally apply. StreamWizard is an independent third party and not affiliated with these platforms unless expressly stated. The YouTube workflow is intended exclusively for the Google Data Portability flow with your own or authorized content. We may adjust or disable features if these platforms change requirements or raise objections.

7. Prohibited use

• Attacks (hacking, exploits, DDoS), malware, spam, harassment, unlawful content.
• Circumvention of security, rate-limit, or session mechanisms.
• Using backup control, streamstats, Discord runtime, or token bridge for third-party accounts/channels without authorization.
• Violations of Discord, Twitch, Kick, Google, or YouTube platform rules.

8. Security & tokens

Platform tokens are stored encrypted and used only for the active feature. For OBSBot/giveaway workers, OAuth exchange runs through the token bridge on our server (hybrid encryption RSA-OAEP + AES-256-GCM to the bot instance). Security events are logged with anonymized IP (prefix). Rate limits protect security-critical endpoints; violations lead to temporary or permanent blocks. Report security issues via /.well-known/security.txt.

9. Account, liability, termination

You can delete your account and export your data in the dashboard. We are liable without limitation for intent, gross negligence, injury to life/body/health, and under product liability law. For slightly negligent breach of essential contractual obligations, we are liable for the foreseeable damage typical for the contract; otherwise liability for slight negligence is excluded to the extent permitted by law. For free services we provide no warranty regarding availability, error-free operation, or outcome. We may block access on violations; you may stop using the service at any time.

10. Changes & contact

We may adjust these terms when services, technology, or legal requirements change. The version published here is authoritative. Questions: support@streamwizard.de.
