Legal & transparency
These are the terms for paid StreamWizard services, especially software licenses and rental/subscription models around OBSBot and the giveaway system. Free platform features are additionally governed by the terms of service.
These terms and conditions apply to all paid services on streamwizard.de, especially premium subscriptions, VIP yearly access, Diamond lifetime access, and paid rights to use StreamWizard software such as OBSBot and the giveaway system (incl. Streamstats), and related update/service components. This also includes paid services related to platform integrations for Discord, Twitch, and Kick. For free use of the platform, the terms of service additionally apply.
The contracting party is the provider named in the imprint.
These terms apply to consumers and businesses. A consumer is any natural person entering into a legal transaction for purposes predominantly outside their trade, business, or profession. A business is a natural or legal person or a legally capable partnership acting in exercise of its trade, business, or profession when entering into a legal transaction.
The subject matter is the paid provision of digital StreamWizard services. This includes time-limited or permanently granted rights to use OBSBot and the giveaway system (incl. Streamstats), updaters, and related software components as well as account-bound premium/VIP features. Unless expressly agreed otherwise, only a simple, non-exclusive, non-transferable, and non-sublicensable right of use is granted for the agreed term or scope of use.
We do not owe any specific economic outcome. The scope of services may be adjusted if required for technical, security, licensing, platform-related, or legal reasons and if the change remains reasonable for you. This applies in particular where APIs, platform rules, moderation requirements, or approval requirements of external services such as Discord, Twitch, Kick, Google, or YouTube change. Where a rental, subscription, or other time-based model is selected, the right of use ends automatically when the paid period expires.
For paid digital products and digital services towards consumers, the statutory warranty rights under §§ 327 et seq. of the German Civil Code (BGB) and our statutory update obligation under § 327f BGB apply. These rights are not excluded or limited by these terms; the above provisions on service adjustments leave them unaffected.
A paid license to StreamWizard software does not grant any independent rights to trademarks, logos, APIs, services, or content of Kick, Twitch, Discord, Google, YouTube, OBS, or other third parties. Such designations are used solely to describe intended compatibility. You remain solely responsible for the permissible use of your third-party platform accounts, channels, servers, streams, content, and the optional YouTube/Google workflow.
License holders with an active Premium, VIP, Super VIP, Diamond, admin, or owner license may invite other registered StreamWizard users as "delegates" to their tenant. Delegates thereby receive only limited remote-control rights via the dashboard for the inviting license holder's OBSBot (e.g., start, stop, skip, start stream, create playlist, recover/update, hide message).
Delegates do not receive their own license, software download, or access to the license holder's license, payment, subscription, or owner API data. They may create a personal, revocable Team API key for capped read access to the viewer and Giveaway data shared with them; this key grants no write access and no unrestricted full export. Delegate access is personal, non-transferable, and technically limited to the relevant tenant or shared channels. Invitations are valid for 7 days and can be used once; a license holder may have at most 5 active delegates at any time.
The license holder remains responsible for all actions triggered by delegates on their tenant. The holder can revoke invitations and active delegates at any time in the dashboard; delegates can likewise end their access to a tenant at any time.
Streamstats is a separately enabled area for Twitch statistics. Use requires admin entitlement, an active Twitch connection with the required scopes, and a privacy acknowledgement in the dashboard. There is no team or delegate sharing for Streamstats; entitlement is personal and non-transferable.
As creator or license holder, you remain responsible for using Streamstats only for your own or lawfully managed Twitch channels, properly informing affected viewers in your stream/community context, maintaining ignore lists only where necessary, and not importing or processing data for which you lack the required authorization. This also applies to viewers who do not have a StreamWizard account and whose activity is captured only through Twitch, bot runtime, or lawfully initiated imports. StreamWizard does not evaluate these viewer data for its own giveaways, own viewer profiles, or own marketing purposes.
Where Streamstats processes on our servers tokens, Twitch channel identifiers, viewer names, Twitch user IDs, ignore lists, or aggregated counters, storage follows the intended data-minimizing security model: reversible identifiers and tokens are encrypted with system encryption, lookup/matching values are stored as tenant- and purpose-scoped hashes. Technical counters such as watch time, message counts, bits, or gift subs are stored as calculable operational values because evaluation, sorting, rollover, and support would otherwise not work. Streamstats counts only the number of chat messages per viewer; the contents or text of chat messages are not stored.
The StreamWizard Giveaway system is a technical platform feature for creators. As creator, you decide whether and how you operate a giveaway or community prizes, which rules apply, which prizes are offered, which viewers may participate, whether participation is possible through the public page with Twitch login or without a StreamWizard account through Twitch chat commands, which blocklists or ignore lists apply, whether data from Twitch, StreamElements, Streamstats, or chat commands are included, and whether winners are announced in chat. For creator giveaways and community prizes, StreamWizard is neither organizer nor sponsor, does not provide prizes, does not run the giveaways in its own name, and does not make content decisions about eligibility, winner communication, tax/duty questions, or compliance with your platform and giveaway rules.
You may use participant, viewer, loyalty, or import data in the Giveaway system only where you may lawfully process them in the respective channel and platform context. This applies especially to StreamElements imports, manually maintained blocklists, moderator commands, Streamstats synchronization, and winner information. If you use chat commands, imports, or sync functions, people without a StreamWizard account may enter the Giveaway data set; the public StreamWizard page alone then does not replace your notices in the Twitch/community context. You are responsible for clearly informing participants about rules, prize fulfillment, privacy, and contact options and for complying with legal, tax, youth-protection, and platform-related requirements.
StreamWizard protects the technical data through tenant separation, admin entitlement, CSRF/origin protection, rate limits, logging, and the enc/hash storage model. Reversible Twitch IDs, logins, display names, tokens, and comparable identifiers are stored encrypted; lookup, dedupe, blocking, and ticket assignment use hash values. Points, tickets, watch time, winner status, timestamps, and similar operational values remain stored as calculable technical values but are processed only within the respective creator context.
As a protection feature ("Bot Protection") you can maintain a block list of Twitch login names. For listed names, no new points, watchtime, or bonuses are credited in the giveaway (accrual is frozen); the existing balance is preserved unchanged – nothing is set to 0 or deleted. Viewers with a genuine monetary contribution (active sub, bits, or gifted subs) are exempt from the freeze and keep earning normally; lifetime values, bits, and chat message counters remain unaffected anyway. Giveaway points and tickets are free participation values with no monetary value; they are not part of any paid license, are not redeemable, and establish no claim to continued existence. They may be reset on suspicion of bot, multi-account, or abusive participation. As creator, you are responsible for blocking only names you may lawfully block in the respective channel context and for correcting any wrongful blocks yourself.
All prices stated on the website are final prices. As a small business under German VAT law (§ 19 UStG), VAT is not shown separately.
For contract performance, we only store necessary technical subscription/status information on our side (e.g., customer/subscription references, status, period end) in a security-oriented enc/hash model; full payment data is not processed on our servers.
After successful payment, we may send you transactional purchase confirmations by email. Where technically enabled for premium, VIP, or Diamond purchases, a service such as Trustpilot may additionally be integrated to send a review invitation on our behalf based on that purchase confirmation. Details of data processing are governed by the privacy policy.
For voluntary support as well: the stated amount is a final price. As a small business under section 19 of the German VAT Act, VAT is not shown separately.
In case of failed or charged-back payments, serious violations of these terms, the terms of service, third-party platform requirements, or security incidents, paid services, software licenses, rental models, and related API/runtime access may be restricted or suspended until clarified.
For traceability and abuse prevention, technical security logs (including anonymized IP prefixes) may be processed in this context.
Consumers have a statutory right of withdrawal. For digital content, digital services, or software licenses activated immediately, the right of withdrawal may expire early under statutory provisions, especially if performance begins before the withdrawal period ends after you have expressly consented and acknowledged possible expiry of the right.

For paid services, the liability provisions in the terms of service also apply. Mandatory statutory liability, especially for intent, gross negligence, injury to life, body, or health, for breaches of essential contractual obligations within the statutory framework, and under product liability law, remains unaffected.
To the extent that paid features depend on the availability, approval, tolerance, or technical design of external platforms such as Discord, Twitch, Kick, Google, or YouTube, we are not liable to the extent permitted by law for changes, suspensions, policy adjustments, or moderation decisions made there.
We may amend these terms with future effect where there is an objective reason (e.g., changes in law or supreme-court case law, service development, changes to external platforms, or closing regulatory gaps) and the change does not unreasonably disadvantage you. The ratio of performance and consideration (in particular the prices) is excluded from this amendment reservation.
For ongoing continuing obligations (in particular the premium subscription), we offer you changes at least six weeks before the proposed effective date in text form (e.g., by email or via the dashboard). Your consent is deemed granted if you do not reject the change before the proposed effective date. We will separately point out this consequence (deemed consent) and your right to reject and to terminate in the change offer. If you reject, we may ordinarily terminate the contract as of the change's effective date; in this case you may likewise terminate free of charge until the effective date.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as mandatory consumer protection provisions of the country of habitual residence are not withdrawn. If the customer is a merchant, legal person under public law, or special fund under public law, exclusive jurisdiction is at the provider's registered seat.
If individual provisions of these terms are or become invalid, the validity of the remaining provisions remains unaffected. Statutory provisions apply in place of the invalid provision.
